Every now and again a court stands up to our out of control federal government. Such was the case when a three judge panel in New York recently rapped the knuckles of the FCC over their rule regarding expletives uttered on live broadcasts off the cuff. The so-called “unscripted” expletives have long been a source of contention for people who think that the federal government has somewhere, but they are not quite sure where, in the Constitution the power to regulate speech.

In fact, despite a clear reprimand against such things in the First Amendment the government has done it anyway. Their tactic has been a sneaky one whereby Congress, who is the sole body entrusted with making federal law and the body specifically prohibited from violating the free speech of citizens through acts of law, abdicated their ability to make law on certain matters to other organizations like the FCC. Thus, the theory has gone, because the FCC is not Congress that the FCC can do whatever they want. It doesn’t really work though because the FCC was created by Congress and thus all acts of the FCC are de facto acts of Congress and thus all unconstitutional acts by the FCC are just as unconstitutional as they would be if Congress passed them directly.

I know, there are a lot of you out there that are offended by certain words. These words grate at you because, well, you are offended by them. Other words that mean the same thing can be used but not these, hideous (in your own mind) words. It is a silly claim and one in which true conservatives can easily weed out false conservatives.

The crack down by the FCC for unscripted expletives came under former President Bush who repeatedly showed people why Republicans, while 100 times better than your typical Democrat, must be watched like hawks to make sure they are not acting like little tyrants. Now it has been temporarily put on hold

However, count on this heading to the Supreme Court where it is anyone’s guess as to whether or not the conservative block will hang together and stop liberal thinking and a violation of the first amendment to stand. Hopefully they will uphold this ruling. And then people who get offended so easily over words will have to find something else to get mindlessly upset about.

You don’t like what is said on a radio or television station? Change to another. And if individual stations want to self sensor, that is ok too. They are not Congress and they can do it. That is liberty.

Representative Alan Grayson is great. He is great because he is a moonbat who does not filter what he says. Every lie rolls off his tongue with ease as he parrots DNC talking points and his fascist streak is in plain view. And he is at it again.

Yesterday I mentioned the case of a Mount Dora doctor who, on his own property and in his own practice, decided to practice some freedom of speech. You know, liberty? He posted a sign telling people coming to see him that if they voted for Obama as President that they should go elsewhere for services. In that article we already knew that Mr. Grayson was in high dudgeon over the gall of this man to tell people that voted for his Lord and Master to go pound salt.

The outspoken Grayson described Cassell’s sign as “ridiculous.”

“I’m disgusted,” he said. “Maybe he thinks the Hippocratic Oath says, ‘Do no good.’ If this is the face of the right wing in America, it’s the face of cruelty. … Why don’t they change the name of the Republican Party to the Sore Loser Party?“

Private property, freedom of speech and even liberty as a whole be damned! Such criticism and choices are not to be allowed under the messiah and Rep. Grayson envisions himself as a demigod in the pantheon of liberals currently dictating to us from on high.

Well now there is more information on how Rep Grayson is preparing to act to punish this doctor. He is going to file a complaint:

An outspoken U.S. congressman is planning to file a complaint against the central Florida urologist who posted a sign on his office door warning supporters of President Obama to find a different doctor.

A spokesman for Rep. Alan Grayson, who angered Republicans last year when he said they wanted sick Americans to “die quickly,” told FoxNews.com that Florida Democrat is helping a constituent who was affected by the sign to file a complaint next week with the proper authorities. Grayson will also file additional complaints with all relevant boards or agencies, Grayson spokesman Todd Jurkowski said.

Just one small problem though apparently. And as usual Mr. Grayson is acting and speaking so off the cuff that he has once again proven himself the fool we all know he is.

A spokeswoman from the Florida Department of Health, which licenses physicians and investigates complaints, said Friday there was no law prohibiting Cassell from advertising himself this way.

“Because there is no statute, there would be no grounds for a complaint,” spokeswoman Eulinda Smith said. “It would be legally deficient.”

Do not expect that to stop Mr. Grayson though. He’s a liberal and as a liberal he knows how to find words written into laws with invisible ink that only he and his fellow travelers can see. And he will cite these hidden words as justification for his actions. Hey, they have been doing it with the Constitution for year finding powers that don’t exist!

This man needs voted out of office for the simple reason that he is an anathema to everything that America stands for and as a practitioner of politics reminiscent of the rejected Soviet era of government across the sea he should be sent into retirement for the good of the Republic. And while we are at it he should be forced onto government run health care too just because he thinks it is such a great idea for the rest of us.

Right now I am preparing myself for the inevitable onslaught of angry emails from indignant McCain supporters who just hate how I point out how utterly stupid and unqualified to be a Senator this man is. These emails ignore the truth of the mater and the facts that I discuss and almost always resort to the final claim that because he served in the military and served as a POW that he deserves more respect than I give him. I know the claim is vacuous and put forth by sophomoric types that cannot legitimately defend a man who has been one of the biggest destroyers of our Republic. But I am ready for them none-the-less.

Arizona Senator John McCain is the epitome of a RINO. His horn, grown large from years of drinking the liberal Kool-Aid, is not even in dispute. Give him a chance to do something unconstitutional and odds are that he will at least seriously consider it if he thinks it will not put his political life in jeopardy.

And if by chance he miscalculates and sees anger directed at him for his actions? Well, he will blame someone else like a good liberal.

I will be as bluntly honest as I can here. The more John McCain opens his mouth and spouts words the dumber I know he is. As if his previous defenses of stupid acts drafted by him such as Congress placing unconstitutional limits on free speech were not absurd enough, McCain is at it again.

The Senator voted for TARP. TARP was wildly panned as a problem when it was introduced but McCain got on board with it anyway. Now that TARP is even more unpopular now and McCain is getting pummeled from his right on this issue by JD Hayworth it is time for more excuse making.

In response to criticism from opponents seeking to defeat him in the Aug. 24 Republican primary, the four-term senator says he was misled by then-Treasury Secretary Henry Paulson
and Federal Reserve Chairman Ben Bernanke. McCain said the pair assured him that the $700 billion Troubled Asset Relief Program would focus on what was seen as the cause of the financial crisis, the housing meltdown.

“Obviously, that didn’t happen,” McCain said in a meeting Thursday with The Republic’s Editorial Board, recounting his decision-making during the critical initial days of the fiscal crisis. “They decided to stabilize the Wall Street institutions, bail out (insurance giant) AIG, bail out Chrysler, bail out General Motors. . . . What they figured was that if they stabilized Wall Street – I guess it was trickle-down economics – that therefore Main Street would be fine.”

So … Hmmm … what you are saying Mr. McCain is that you were too stupid to know that government money would not be spent in the way you thought it would? Hello! Earth to space cadet John! Where have you been for the past couple of decades?

And besides John, may I call you John? And besides John this is an poor excuse from you. There is no single point in the federal Constitution which you are supposed to uphold that gave government a single shred of authority to even enact TARP in the first place! Think about it John. If you had actually upheld the Constitiution and voted no on TARP there would be no attacks directed at you today for having supported it! But now with your political life on the line you have decided to run as far right as you can personally tollerate and pretend that TARP was someone else’s fault.

Too dumb to serve, too smart to be institutionalized; that’s you in a nut shell Mr. McCain. Step aside. America needs leaders not more sycophants willing to just tow the line and go along with the progressive agenda of ignoring the Constitution and destroying America only to blame someone else when their actions are not well liked.

Time to take your pension and go retire. Please! It would be money well spend in my opinion. If you love America John you will!

Recently I mused about whether or not liberals, and the Democratic Party they call home, have any popular ideas whatsoever on my blog. Seems as though every time a poll is taken on the specifics of what they want to do, not necessarily the overall idea, they are met with a wall of public opposition.

Liberals try to spin their ideas as popular. For example, with the recent health care “reform” debate, when generic questions were asked about whether or not people are for reform the majority said yes. Liberals would then rush to the microphones and tout support for their ideas. However, when it comes to actually asking people whether the public supported the further socialization of health care, which is what the Democrat’s plan was (ie. more government control), the public was overwhelmingly against them.

In the case of health care reform, people are for reform. But they are for cutting back on the government intervention which causes there to be only two insurers able to operate in an area and thus reducing competition and driving up costs, tort reform and other common sense fixes.

Well, once again I am forced to ask the same question I previously asked. Do the liberals have any popular ideas? And this is because of the recent ruling from the Supreme Court which struck down a myriad of regulations that prohibited corporations, which are just collectives of people and endowed with the same rights as individual citizens, from partaking in free speech.

The reaction from liberals was predictable. They were not happy.

Examples:

“With its ruling today, the Supreme Court has given a green light to a new stampede of special interest money in our politics. It is a major victory for big oil, Wall Street banks, health insurance companies and the other powerful interests that marshal their power every day in Washington to drown out the voices of everyday Americans. … We are going to talk with bipartisan congressional leaders to develop a forceful response to this decision.” – President Barack Obama

Yeah, but labor unions who represent a vast minority of working Americans and wacko groups like MoveOn.org (who contrary to their name have found it hard to “Move On”) are ok! Right Mr. Obama? Oh, and of course groups of people that support you are not, “powerful interests that marshal their power every day in Washington to drown out the voices of everyday Americans?” Give me a break you political hack!

“Presented with a relatively narrow legal issue, the Supreme Court chose to roll back laws that have limited the role of corporate money in federal elections since Teddy Roosevelt was president. Ignoring important principles of judicial restraint and respect for precedent, the court has given corporate money a breathtaking new role in federal campaigns.” – Sen. Russ Feingold, D-Wis

Whahhhh!!!!! Again, exactly why should some people be prevented from having their free speach rights because they have joined together to form a group? What part of, “Congress shall make no law,” is so hard for your liberal mind to understand? Is it the word, “no?”

“There is clear reason for ordinary citizens to be concerned that this divisive ruling will, in reality, allow powerful corporations to drown out the voices of everyday Americans in future campaigns. This ruling is no doubt yet another victory for Wall Street at the expense of Main Street America.” – Chairman of the Senate Judiciary Committee, Sen. Patrick Leahy, D-Vt

Once again, Leahy apparently has no problem with liberal groups like Big Labor drowing out the voices of “everyday Americans” though. The faux outrage is evident!

Oh, then of course there is moonbat extraordinaire, Rep. Alan Grayson from Florida. You remember him. He is the crack pot that actually said that it was the Republican plan with regards to health care for people to, “die quickly,” even though it is his fellow liberals that have often expressed the need to kill off the people who are burden to society. He said:

“The Supreme Court in essence has ruled that corporations can buy elections. If that happens, democracy in America is over. We cannot put the law up for sale and award government to the highest bidder.” – Rep. Alan Grayson, D-Fla

This is just a sampling of the complaints from the left. Well, the American people once again disagree. No real surprise there! From Gallup:

PRINCETON, NJ — Americans’ broad views about corporate spending in elections generally accord with the Supreme Court’s decision Thursday that abolished some decades-old restrictions on corporate political activity. Fifty-seven percent of Americans consider campaign donations to be a protected form of free speech, and 55% say corporate and union donations should be treated the same way under the law as donations from individuals are. At the same time, the majority think it is more important to limit campaign donations than to protect this free-speech right.

Any popular ideas there Democrats? Any at all?

Can we please stop playing this game and stop electing these fools? Please! I don’t understand why Americans who obviously are against everything the left has planned are so interested in sending them to Washington every couple of years. Are you folks voting for these people just not paying attention? Or is your handout of choice enough to buy your loyalty and cause you to look the other way? Not that either excuse is better than the other mind you.

Oh you die hard Republicans who are Republicans first and everything else second wonder why I criticize the Republican Party and their candidates and their voter’s willingness to do the right thing and utimately worry about the Party? You really really wonder these things? Honestly?

Ok, well this is why I worry about the Republican Party! Senator John McCain, Mr. I can abridge free speech because I am a Senator and Mr. I can throw money at the banks unconstitutionally is sitting pretty with voters in Arizona at the minute and looks like he will get a chance to run for re-election in 2010 according to a Rasmussen poll of voters in the State.

A new Rasmussen Reports telephone survey of likely 2010 Republican Primary voters in Arizona finds the longtime incumbent leading former Congressman J.D. Hayworth by a 53% to 31% margin. In November, the two candidates were virtually even.

Former Minuteman leader Chris Simcox gets four percent (4%) support, while three percent (3%) prefer some other candidate and eight percent (8%) are undecided.

Ok, as far as Simcox goes I can understand that … maybe. He is pretty much a one trick pony. And I am not saying that Hayworth is the best Republican candidate out there or that I even agree with him on everything but he is by far and away a better person and stronger conservative than John McCain could ever hope to be. My opinion. So if you don’t like it I don’t honestly care.

But really, are you really going to tell me that John McCain, after everything he has done, deserves to be re-elected? Heck up until recently when it was politically expedient he has pretty much been Obama-lite for years in the Senate.

Hey, far be it from me to tell you want to do. And I am not endorsing Hayworth either lest you think that. I am just saying you vote for McCain and you get the government you deserve and punish the rest of us in the end. Think about that please.

Well, not really a surprise. This what liberals always do. They get caught doing naughty things and then they sue those that expose them. ACORN has now filed suit against Brietbart's BigGovernment.com, O'Keefe and his partner Giles because Maryland law requires two party consent for audio recordings of conversations. The short explanation for such a law is that Maryland wants to protect people too stupid to watch what they do when interacting with other people.

Well, not really a surprise. This what liberals always do. They get caught doing naughty things and then they sue those that expose them. ACORN has now filed suit against Brietbart’s BigGovernment.com, O’Keefe and his partner Giles because Maryland law requires two party consent for audio recordings of conversations. The short explanation for such a law is that Maryland wants to protect people too stupid to watch what they do when interacting with other people and who might discuss illegal acts. Personally the law is probably borderline unconstitutional because it prohibits someone from obtaining evidence as to what someone else said in a conversation (without their consent) so that party A can defend themselves against party B in case of a slander or libel lawsuit. Such is a dangerous restriction to place on free speech as it leads to situations where speech might not be engaged in because even though both parties know what was said, the party seeking to expose it would not be able to prove it with such a law. It also hinders freedom of the press and reporting and the ability to back up one’s story.

That aside, the complaint is really typical liberal psychobabble:

But ACORN says no tax returns were actually prepared at the Baltimore office, and that the audio portion of the video recorded there was obtained illegally, since Maryland requires two-party consent for sound recordings. The multimillion-dollar lawsuit cites “extreme emotional distress” on behalf of two workers who were fired after the video was posted online.

The videos were “clear violations of Maryland law that were intended to inflict maximum damage to the reputation of ACORN, the nation’s largest grassroots organizer of low-income and minority Americans,” said ACORN attorney Arthur Schwartz. “Unfortunately they succeeded.”

Problems with this line of “logic” are many. First of all and most prevalent however is that the employees willfully engaged in the conduct caught on tape so any “emotional distress” that was suffered by them for now not being able to help tax cheats or set up child prostitution rings was brought on by their own actions not O’Keefe or Giles. Second of all, whether or not the actions were intended to damage ACORN’s reputation or not is a moot point as, once again, it was indeed ACORN’s own employees that engaged in several illegal acts on tape. The damage to their reputation, as low as it is, is again by their own doing. As for ACORN’s organizing activities you note there is no mention of tax cheats and pimps of child prostitutes included conveniently in that list.

As for the, “unfortunately they succeeded,” comment, well, I take it we can assume that ACORN finds it unfortunate that people expose those attempting to aid and abet tax cheats as well as those trying to aid and abet those attempting to set up child prostitution rings. I don’t think ACORN or thier lawyers think too much before they issue such idiotic comments because they look absolutely silly when they are placed in context.

Sadly for ACORN all their attempts at deflecting blame just continues to show that they don’t much care about the truth. If they were an honest organization they would have weeded out this rampant and apparently easy to find corruption on their own or at the very least praised O’Keefe and Giles for helping them find out about something they were apparently blind to … yeah right. ACORN knew this was going on. They knew that their employees were helping people break the law. Just watch the tapes and see how easily each of the workers confronted give advice without much thought and how often it happened. That sort of response does not come from people that are not used to giving such things on a regular basis.
